Terms of sale
These conditions aim to
define the terms of sale between the seller, the company ML Consulting, and the
customer via the website marielichtenberg.com, from the order to the services,
through to payment and the delivery. They regulate all the steps necessary to
place the order and ensure the follow-up of the order between the contracting
parties.
I. APPLICABILITY AND
ENFORCEABILITY OF THE GENERAL CONDITIONS
All
orders placed on the marielichtenberg.com website are subject to these terms
and conditions, the acceptance of which constitutes a determining factor
without which the seller would not have contracted. Any placing of an order
requires and implies the express and unreserved acceptance of these general
conditions of which the customer has been informed prior to the order on the
marielichtenberg.com website where they can be consulted directly. The seller
reserves the right to modify its general conditions at any time. In this case,
the applicable conditions will be those in force on the date of the order or of
the express acceptance of the order (Paris day and time, France).
The fact that the seller does not avail itself of any
of the present stipulations at a given time may not be interpreted as a waiver
of the right to avail itself of them at a later date.
II. REGISTRATION
All orders require the
preliminary registration of the customer on the website marielichtenberg.com by
creating an account gathering his/her personal information. The customer's
registration on the website is validated by the seller after verification of
the customer's subscription to the standard form. After validation, the
customer receives an email confirming the registration. When creating and
updating an account, the customer is responsible for the accuracy, completeness
and currency of the personal data provided. In the event of an error in the
addressee's details, the seller shall not be held responsible for the
non-delivery of the products and the customer shall not be entitled to claim
any refund or compensation.
III. ORDERS
The confirmation of
order by the customer on the website marielichtenberg.com qualifies as a
signature, and acceptance of the transaction and the contract. All the data
entered by the customer and the recorded confirmation of his/her order will be
considered proof of the transaction. A summary of the order information and
these general terms and conditions will be sent to the customer by email to the
email address used to confirm the order. The customer is reminded that the
seller favours small quantities of stock in order to guarantee the rarity and
exclusivity of the items. Thus, the seller undertakes to honour orders received
on its website only within the limits of available product stock. If the
product is not available, the seller undertakes to inform the customer but
cannot be held responsible for the cancellation of an order for a product due
to its unavailability.
The seller reserves the right not to register a payment, and not to confirm an
order for any reason whatsoever, and more particularly in the event of a supply
problem, or in the event of difficulties concerning the order received.
IV. WITHDRAWAL
In accordance with the
provisions of Articles L.221-18 et seq. of the Consumer Code, the customer has
a period of 15 days from receipt of the products to exercise his/her right of
withdrawal without having to justify his/her reasons or pay any penalty. In the
event that the customer wishes to do so, he must make a return request by email
to the address hello@marielichtenberg.com so that the seller can validate this
request. Returns are to be made by the customer and at his/her expense, by
parcel post, within fourteen days of the communication of his/her decision to
withdraw, in their original state and complete (packaging, accessories, certificate
of authenticity). If the customer exercises his/her right of withdrawal, the
seller reserves the right to defer reimbursement until the goods have been
recovered. The seller will make this refund using the same payment method as
the one used by the customer for the initial transaction, unless the customer
expressly agrees to use another payment method and insofar as the refund does
not incur any costs for the customer. Any damage to the product during the
return shipment can be a reason for not exercising the right of withdrawal. The
seller reserves the right to accept or refuse the returned product depending on
its qualitative condition and in this case not to refund it.
V. PRODUCTS -
EXCLUSIONS
Only the products
mentioned in the orders confirmed in accordance with Article III above shall
fall within the scope of the seller's obligations. The products offered for
sale are those described on the website on the day that the customer consults
it, within the limits of available stock. These indications are updated
automatically in real time. However, the seller shall not be held liable for
any error or delay in updating, regardless of its origin.
The seller takes great
care in the presentation and description of his/her products to provide the
customer with the best possible information. However, it is possible that
errors may appear on the website, which the customer acknowledges and accepts.
The customer may also receive, following an order, a part previously returned
by another customer, which he acknowledges and accepts, without being able to
call into question the order in this respect, since it is specified that the
seller only accepts the return of products that are intact, tried on but not
worn, and that these conditions are checked before the returned products are
placed back in stock.
VI. EXCHANGES AND
REFUNDS
Apart
from the legal provisions on the right of withdrawal, the seller is under no
obligation to accept requests for an exchange or refund from the customer. If
necessary, any request for an exchange or refund must be sent by email to
hello@marielichtenberg.com by the customer, who must indicate his/her full
name, telephone number, order number and the reason for the return. In the
event that the seller accepts the request for exchange or refund, the postal
return address will be sent by email to the customer, who must then return each
product complete (packaging, accessories, certificate of authenticity), in its
original condition and in its original packaging. No Cash on Delivery shipments
will be accepted for any reason. Return shipping is free for exchanges only.
They remain at the customer's expense in the event of a refund request. In the
case of exchange in France (and exchange only), the postage costs of the second
shipment are offered to you, if and only if there was an error by the seller on
the product ordered and/or its quality. If the return is justified by an error
of the customer regarding the size of the order or if he/she does not like the
colour, texture, cut or more generally of the visual rendering, the seller will
not be held responsible and the carriage costs of the second delivery will be
the responsibility of the customer.
VII. DELIVERY
The
seller delivers in France and most other countries. Orders are shipped from
Paris, France, to the address mentioned on the electronic invoice issued upon
confirmation of the order and on the basis of the information provided by the
customer, within the period indicated on the order validation page. Delivery
times, which only begin to run from the day the order is validated and paid
for, are communicated as an indication, so that their non-observance cannot
give rise to deductions, compensation or damages, nor can they motivate the
cancellation of orders in progress. Deliveries are made according to stock
availability and supply times and subject to possible technical difficulties.
The seller shall not be liable for any delays in delivery due to our supply
from our suppliers, nor shall we be liable for any penalties or damages of any
kind whatsoever caused by delay or non-delivery due to force majeure or fortuitous
events. Force majeure is any circumstance beyond the control of the seller that
results in a stoppage or reduction of production or delivery by its own
suppliers. In the event of force majeure, the seller's obligations shall be
suspended without any particular formality, and the seller shall be released
from all liability. As an indication, orders validated before 1pm (Paris time,
France) are generally dispatched the same day, or, failing that, the next
working day. Any order placed on Friday after 1pm, Saturday or Sunday cannot be
sent until the following Monday (excluding public holidays). In case of a
longer delay, the customer will be informed by email. The risks of transport
are borne by the customer, who must make a reasoned protest to the postal
services or to the carrier within three working days of delivery. Upon receipt
of the order, the customer shall check the conformity of the products received.
Any anomaly concerning the delivery (missing or damaged product) must
imperatively be notified, on the day of receipt or at the latest on the first
working day following receipt, to the customer service department
hello@marielichtenberg.com, without which the seller cannot undertake to refund
the order. The products delivered are in conformity with the seller's offers,
subject to the tolerances permitted by the practices of the profession and the
manufacturers. The seller only guarantees the products sold under the
conditions and within the limits of the legal guarantee of conformity provided
for by Articles L. 217-1 et seq. of the Consumer Code and the legal guarantee
for hidden defects provided for in Articles 1641 et seq. of the Civil Code.
VIII. PRICES
The prices of our
products are indicated in euros (€) including all taxes (VAT and other taxes
applicable on the day of the order, unless otherwise indicated and excluding
shipping costs). All orders, regardless of their origin, are payable in Euros.
For orders to a country other than France, the customer becomes without
reservation the importer of the product(s) concerned. Customs duties or other
local taxes or import duties or state taxes may be payable. These rights and
sums are not the responsibility of the seller, ML Consulting. They will be at
the expense of the customer, who is entirely responsible for them, both in
terms of declarations and payments to the competent authorities and bodies of
the country concerned by the delivery. The seller advises the customer to check
with the local authorities beforehand. The customer is informed that in the
event that the payment is made from a country other than France, his/her bank
may charge him/her fees. They are not the responsibility of the seller and are at
the expense of the customer. The seller reserves the right to modify its prices
at any time, so that the product will be invoiced on the basis of the price in
force at the time of validation of the order and subject to availability.
IX. PAYMENTS
The
validation of the order, which seals the contract, obliges the customer to pay,
prior to shipment, the full price of the product(s) ordered with its
accessories (VAT, shipping costs, etc.). Payment for purchases is made by
credit card, using our payment partner, Stripe. The customer's credit card data
is encrypted on the customer's computer and transmitted directly to the bank
operator, which decrypts it and manages the direct debit authorisations. The
seller reserves the right to refuse any order or any delivery in the event of
total or partial non-payment of an order, of a refused credit card payment, of
a previous or current dispute with the customer or for other reasons for which
the seller will reserve the right to explain to its customer. ML Consulting
cannot be held responsible in any way for this.
